Free appropriate public education (FAPE) is a special service offered for children and adolescents who have attention deficit hyperactivity disorder (ADHD) and learning disabilities. Under this service, people with ADHD and learning disabilities have access to educational opportunities that are equal or similar to the opportunities available for young people without these disabilities.
Two laws exist to ensure that children with ADHD have access to FAPE. These laws are Section 504 and the Individuals with Disabilities Education Act (IDEA). Section 504 offers help for children who only need minor adjustments to their school day and is often easier to qualify for. To qualify for FAPE under Section 504, a child must have a mental condition or physical condition that impairs a "major life activity," requiring the child to need unique educational interventions.
IDEA is designed for children with ADHD who also have learning disabilities. Extensive testing is required to gain benefits under IDEA, and the modifications offered under this law are often more comprehensive and extensive than the assistance offered under Section 504.
